Andrew ESHBAUGH or ASHBOUGH, member of the Fifth Class of the Inhabitants of Mountjoy Township, classified under an Act of Assembly passed in 1780, entitled "An Act to compleat the Quota of the Federal Army;" each class was "required to provide, in fifteen Days from this Date [January 30, 1781], one able-bodied Recruit for the Continental Army, to serve during the War," under penalty of a fine of L15.0.0 specie: this class furnished a recruit.
Andrew owned 120 acre farm known as "Andrews Burgh" & "Speedwell" in Mountjoy Twp., Adams Co., PA. He was known as both a farmer & a potter. His estate was appraised at $1586.10. Andrew may have been born 1.) in Germany immediately before his parents emigrated to America; 2.) on board the ship; or 3.) in Philadelphia, immediately after his parents landed. Andrew ASHBOCH/ASHBOUGH appears in Mt. Joy Twp., Adams Co., PA censuses of 1800 & 1810.
WILL OF ANDREW ASHBAUGH
ADAMS COUNTY, PENNSYLVANIA WILL BOOK B (p.16); 1814
In The Name of God Amen etc. etc. - I Andrew Ashbough of Mountjoy township Adams County in the state of Pennsylvania farmer being weak and frail of Body but of sound mind and memory (Thanks to God for the same) do this twenty fifth day of March in the year of our Lord one thousand Eight hundred & thirteen make and publish this Instrument of writing as and for my last will and testament in manner and form following (that is to say) first of all I order will and allow all my Just debts to be well and truly paid as soon after my decease as my Executors Conveniently Can.
secondly) I Give and bequeath to my wife Mary Ashbough as much of my household and Kitchen furniture as she may think proper to Keep, vizt the use thereof, and as may be necessary for her, and one Cow of her own Choice, and twenty dollars to be paid her out of the first money that Comes to my S___ hands after my death, to be holden of her during her natural life, Alfo one third of the yearly produce of my plantation whereon I now Dwell with the use of & Occupation of the Room in my house which we now Occupy, with liberty of the Kitchen as much as she will want to Cook wash and Keep her furniture therein suitable for that purpose, that part of her Garden we now hold, and a small patch for potatoes dunged & plowed & made fit to plant by the renters - and Good & sufficient firewood Cut hawled & laid at her door & made fit for the Kitchen & stove the Grain to be delivered to her in the Bushel and the hay Cut Cured and put on the stable Alfo stabling & pasture for her Cow to be held and Enjoyed by her my said wife for & during her natural life - and I do Enjoin it upon my Executor to see that she is treated with Respect and humanity, & Receives the foregoing in due time & manner so as to render her life Comfortable & Easy.
thirdly) I order will and allow the rest and Residue of my personal Estate to be sold at public Vendue and the money arising therefrom together with the notes bonds and Accounts & Cash I may have at my Death when Collected to be distributed as follows. first paying to my wife twenty Dollars & the Residue to be Equally Divided to and amongst all my Children or the legall Representatives of those dead if any be, leaving such Ifsue the Representatives taking their parents share if one solely, if more than one Equally,
fourthly) I order will and allow my plantation to be rented from year to year during my wifes naturall life reserving to her the priviledges to her bequeathed, my son Allexander Ashbough to have the first offer - but if he will not Accept thereof, or not farm to the satisfaction of my Executors, that then they may rent to any other suitable person they Can, still, however, having Respect to put no person thereon that will render my wife Uneasy, or abridge her priviledges,
fifthly) I order will and allow at the death of my wife my land to be sold by my Executors at public or private sale at their discretion, for one third in hand & the rest in ten Equal annual payments - and when the sum is well and truly paid or secured to be paid to their satisfaction then but not before, to convey the same to the purchaser in fee simple it being patented - and such Conveyance so made by my Executors shall for Ever Ban my heirs & all under them.
sixthly) the money arising from such sale I order to be distributed as follows - As some of my Children have received from me heretofore some more some lefs - and I wish them to be all Equal - then when my Executors receive this first payment of my land, they shall Refer to a sheet of paper where I have made an Account of what I have Given to Each of them Respectively, and in order to Designate that paper from Others I have made my mark thereunto this day - and by that they are to be made Equal out of the payment aforesd. and then being so made Equal, the rest & Residue shall be Equally Divided amongst all my Children if Alive but if any of them be dead leaving lawfull Ifsue then such Ifsue shall Inherit their parents share in manner directed in Case of the personal Estate aforesaid.
and Lastly) I Do hereby Constitute and ordain my son in Law Adam Winterode and my son Thomas Ashbough Executors of this my last will and testament Agreeable to the Intent and meaning thereof but in Case of death resignation or removeable to too Great a Distance of any of my Executors then the Other to Act solely and by himself as if no other had been appointed. In Testimony of this being my Last will and testament I have hereunto set my hand & seal the day & year first above written.

Wilson & George Bonder two of the subscribing witnefses to the foregoing instrument of writing and on their solemn oaths do severally say that they were Personally Present and saw and heard the within named Andrew Ashbaugh sign his mark write and seal and publish the foregoing instrument of writing as and for his last will & testament and at the time of Doing thereof he the said Andrew Ashbaugh was of a sound and disposing mind memory and understanding to the best of their Knowledge and belief and that they subscribed their names thereto as witnefses in the presence of the said testator and at his request and also in the presence of each other at the same time.
